Help Using KSOL

Terms and Conditions for Purchases

All KSOL products and services are non-transferable to any other individual.


Products

Graduate, Masterclass Online OR any other online subscription based service of KSOL - exc. Masterclass in-person and Masterclass Live (online) courses

Whilst tests are delivered Mon-Fri, in the event that any test is missing, you will need to inform KSOL straightaway.

These products are subscription-based services. The Credit/Debit Card used to book the course will be automatically re-billed every 30 days on the 1st of each month. Depending upon the payment cycle, individuals should allow up to 7 days after the renewal date for the card to be charged.

If a card payment is missed by KSOL, we will automatically re-bill when the missed payment is discovered. If however, in the unlikely event that more than 2 months of payment have been missed by KSOL, then we will debit 2 months payment and contact the individual for any additional months. If contact is unsuccessful then we will automatically debit the card for the remaining months.

Cancellations & Refunds

If you no longer require the use of KSOL, you can cancel at anytime by giving one month's notice. However, if you are not cancelling at the start of your subscription payment cycle (1st of the month), you may have a final pro-rata payment to make, in order to complete the 1 month notice period required for cancellations.

KSOL requires one month's notice for cancellations. Only in exceptional circumstances will KSOL consider waiving this notice period, and each case will be evaluated on its own merits. Please note that supporting documentation, such as a medical certificate, may be necessary to substantiate any refund request.

KSOL has the right to cancel subscription at any point.

Refunds will only be accepted in the first 14 days of starting the course. Registration fee is not refunded.

Masterclass Course (in-person, centre-based)

This product is a subscription based service. Payment is made by direct debit, set up by the parent, following instructions from GoCardless, on behalf of KSOL. If the direct debit for your Masterclass monthly payment is not set up at least 7 days prior to the payment due date, we will process the payment using the card associated with your account, along with a £10 administrative fee.

While tests will be delivered Mon-Fri, if in the event any test is missing, you need to inform KSOL straightaway.

If your child is unable to attend on their normal teaching session, you will not receive any refund for that session, as we have allocated that place to your child. We will, however, give them online access to the weekly guided teaching session via their student dashboard.

If the centre is closed due to adverse weather conditions or other situations that are beyond the control of KSOL, then alternative arrangements may be provided, but this is not guaranteed. No refund is provided in lieu. We will endeavour to provide an alternative venue, but if this is not possible, your child will receive online access to the weekly guided teaching session via their student dashboard.

On the dates of KSOL mock exams, the Saturday sessions at Light Hall School will be rescheduled to alternative online sessions. Parents will be informed of these dates in advance. 

Centres will be closed for 2 weeks at Christmas and 1 Week at Easter. In lieu of the centre days, additional work will be provided.

Cancellations & Refunds

KSOL has the right to cancel subscriptions at any point. 

Deposits for reserving Masterclass course places will only be refunded up until 31st July. 

If you no longer require the use of KSOL, you may cancel at anytime by giving one month's notice in writing or email only.

Monthly payments will be taken by direct debit. If payment is not made, KSOL has the right to cancel the tuition and recover any outstanding money owed. We require 1 month's notice for cancellations. Masterclass LIVE Course (face-to-face, online)

This product is a subscription based service. Payment is made by direct debit, set up by the parent, following instructions from GoCardless, on behalf of KSOL. If the direct debit for your Masterclass monthly payment is not set up at least 7 days prior to the payment due date, we will process the payment using the card associated with your account, along with a £10 administrative fee.

While tests will be delivered Mon-Fri, if in the event any test is missing, you need to inform KSOL straightaway.

If your child is unable to attend on their normal online teaching session, you will not receive any refund for that session, as we have allocated that place to your child. We will, however, give them online access to the session material via their student dashboard. 

If your child's session falls on a bank holiday, KSOL will provide access to an online pre-recorded session for that week. 

A modern, working computer with microphone and camera is required.

YR3 Course, YR4 Courses, YR5 Intensive Course & Online Creative Writing Course

One off Payment.
Refunds will only be accepted in the first 14 days of starting the course.
KSOL will aim to issue refunds within 30 days of confirming the user request.
Tests will be delivered Mon-Fri.

Mock Exams

Completing a KSOL Mock exam does not guarantee entry to a grammar or independent school.
All statistics provided after the exam are only given as guidelines and do not constitute a guarantee of any kind.
KSOL will endeavour to send results out within 10 working days after completion of the exam. If results are not received after this period then it is an individual’s responsibility who booked the exam to make the necessary enquiries.

Please note that you will not receive a copy of the exam paper. We ensure that each exam paper tests and reflects the latest information that we have available regarding eleven plus exams. In order to protect our IPR, the exam paper cannot be given to parents.
The exam questions cannot be purchased in any retail/book store. They are unique to KSOL members. All questions are written by KSOL Educationalists and are based on findings from detailed research. 
Please note: At KSOL, we ensure all our 11+ tutors are CRB/DBS checked before we allow them to work with children, whether that be online or in our KSOL centres.

Other Key Information:

Individual exam booking:
Cancellations of individual mock exam bookings can be made 2 weeks prior to the exam date. KSOL will aim to issue full refunds within 30 days of confirming the customer request. Please note, this does not include multiple exam package bookings. However, in extenuating circumstances, KSOL may be able to offer a refund of up to 25% of the original booking price, but this facility CANNOT be guaranteed and will be provided at the discretion of KSOL. Under circumstances where another mock exam event is available, KSOL may offer to transfer your child’s booking, subject to an administration fee of £20. Any alterations would make the booking non-refundable and non-transferable to any other product or course offered by KSOL and be subject to availability.

Cancellations made within 2 weeks of the exam date will NOT be issued a refund.

Multiple exam package booking:
Cancellations cannot be made on individual mock exam events when booked as a multiple exam package booking. If you wish to cancel the full multiple exam package, this is only possible up until the first Saturday in January.


Creative Writing Course (in-person)

Refunds will only be provided if cancellation is requested before 1 month of the start date. 
No refund for days that a child is unable to attend through the child’s own actions. If however, KSOL has to cancel a date or amend a date (or dates), then KSOL will endeavour to hold the days in question on an alternative date or send out detailed explanation of the course material that a child needs to understand in lieu of the missed dates.
KSOL will aim to issue refunds within 30 days of confirming the user request.

Revision Courses

Cancellation Notice: 1 calendar month before start date of assigned course.
Refund Policy: Cancellations made prior to 1 calendar month before the assigned course start date will be issued a full refund; Cancellations made within 1 calendar month of the assigned course start date will NOT be issued a refund.
KSOL will aim to issue refunds within 30 days of confirming the user request.

Any late pick ups interrupt staff time, so a charge of £10 will be applied to parents arriving more than 15 minutes after the session finish time. This fee of £10 will be charged for every 15 minutes (after first 15 mins) that a child is under the care of KSOL staff over the agreed allocated time.

Booster Courses

Live One to One sessions (online):

Cancellation Notice Period: 2 Weeks before the day of assigned One to One session.

Any changes to session times and dates MUST be requested prior to 2 weeks of the assigned One to One session.

Once you have accepted the terms for the 1-2-1 session on the website, you will be accepting that you have a working computer with a working version of zoom installed.

Refund Policy:

•    Cancellations made prior to 2 weeks before the assigned 121 start date will be issued a full refund; Cancellations made within 2 weeks of the assigned 121 start date will NOT be issued a refund.

•    KSOL will aim to issue refunds within 30 days of confirming the customer request.

Other Key Information

Any changes to session topics MUST be requested 7 working days before the assigned One to One session

If you are able to attend the zoom session then we are unable to offer a refund, but, if we can (and only if we can) we will try to organise an alternative date and time.

KSOL LIVE! sessions (online):

Cancellation Notice Period: 2 Weeks before the day of assigned workshop.

Any changes to session times and dates MUST be requested prior to 2 weeks of the assigned workshop.

Once you have accepted the terms for the LIVE session on the website, you will be accepting that you have a working computer with a working version of zoom installed.

Refund Policy:

BACKGROUND:
 
This agreement applies as between you, the User of this Website and KSOL, the owner(s) of this Website. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.
 
No part of this Website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and our acceptance of that offer is deemed to occur upon our sending an email confirmation stating that we will fulfil the order.
 
 
1.                  Definitions and Interpretation
In this Agreement the following terms shall have the following meanings: 
 
“Account”
means collectively the personal information, Payment Information and credentials used by Users to access Paid Content and / or any communications System on the Website;
“Cancellation Notice Period”    means the period after starting a subscription during which customers are entitled to cancel their subscription of a KSOL service.
“Carrier”
means any third party responsible for transporting purchased Goods from our Premises to customers;
“Content”
means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
“Goods”
means any products that KSOL advertises and / or makes available for sale through this Website;
“KSOL”

“Service”
means collectively any online facilities, tools, services or information that KSOL makes available through the Website either now or in the future;
“Payment Information”

“Website”

“Free Content”
means any Content that is accessible without the payment of a Subscription Fee;
“Learning Establishment”
means any provider of education to persons of any age including,  limited to, schools, colleges and universities. and professional / adult education providers;
“Paid Content”
means Content accessible only upon the creation of an Account and the payment of a Subscription Fee;
“Subscription Fee”
means the sum of money paid by Users at predefined intervals to keep their Account active and to enable them to access Paid Content;
“Subscription Period”
means the period for which a subscription has been purchased and may though not necessarily refer to the timeframe accordingly;
“Subscription Service”    means goods or services that are subject to repeat payment.
 
2.                  Age Restrictions
Persons under the age of 18 should use this Website only with the supervision of an Adult. Payment Information must be provided by or with the permission of an Adult.
3.                  Business Customers
These Terms and Conditions also apply to customers buying Goods in the course of business. Please see our Terms and Conditions that relate to business customers.
4.                  International Customers
If Goods are being ordered from outside KSOL’s country of residence, import duties and taxes may be incurred once your Goods reach their destination. KSOL is not responsible for these charges and we undertake to make no calculations or estimates in this regard. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. As the purchaser of the Goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Goods may be inspected on arrival at port for customs purposes and KSOL cannot guarantee that the packaging of your Goods will be free of signs of tampering.
5.                  Intellectual Property
5.1              Subject to the exceptions in Clause 6 of these Terms and Conditions, all Content included on the Website or any of the material provided as part of KSOL’s service’s and products, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of KSOL, our affiliates or other relevant third parties. By continuing to use the Website you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.
5.2              Subject to Clause 7 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website or any of the material provided as part of KSOL’s service’s and products, unless otherwise indicated on the Website or unless given express written permission to do so by KSOL.

                  We are committed to providing parents with the best possible support and services to help their children. KSOL has a ‘Fair Use Policy’ for telephone support, in order to ensure we provide an excellent level of service. We want to make sure that every parent benefits from using KSOL, therefore limits are imposed to ensure equal service to all our customers. 

At the determination of KSOL, we can impose limits to the level of telephone support with customers. Calls that go over 10 minutes will be subject to this policy. Number of support calls per week will also be limited to 2 calls per week, per child.    
8.                  Links to Other Websites from KSOL products
The online products may contain links to other sites. Unless expressly stated, these sites are not under the control of KSOL or that of our affiliates. We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of the use of them. 10.2          You acknowledge that KSOL reserves the right to monitor any and all communications made to us or using our System.
10.3          You acknowledge that KSOL may retain copies of any and all communications made to us or using our System.
10.4          You acknowledge that any information you send to us through our System or post on the enquiry form may be modified by us in any way and you hereby waive your moral right to be identified as the author of such information. Any restrictions you may wish to place upon our use of such information must be communicated to us in advance and we reserve the right to reject such terms and associated information.
11.              Accounts
11.1          In order to purchase Goods on this Website and to use the enquiry form facilities you are required to create an Account which will contain certain personal details and Payment Information which may vary based upon your use of the Website as we may not require payment information until you wish to make a purchase. By continuing to use this Website you represent and warrant that:
11.1.1    all information you submit is accurate and truthful;
11.1.2    you have permission to submit Payment Information where permission may be required; and
11.1.3    you will keep this information accurate and up-to-date.
Your creation of an Account is further affirmation of your representation and warranty.
11.2          It is recommended that you do not share your Account details, particularly your username and password. KSOL accepts no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.
11.3          If you have reason to believe that your Account details have been obtained by another without consent, you should contact KSOL immediately to suspend your Account and cancel any unauthorised purchases that may be pending. Please be aware that purchases can only be cancelled until they are dispatched. In the event that an unauthorised purchase is dispatched prior to your notifying us of the unauthorised nature of the purchase, KSOL accepts no liability or responsibility and you should make contact with the Carrier detailed in the Purchase Information.
11.4          When choosing your username you are required to adhere to the terms set out above in Clause 10. Any failure to do so could result in the suspension and/or deletion of your Account.
11.5          In order to access Paid Content on this Website and to use the facilities you are required to create an Account which will contain certain personal details which may vary based upon the type of Account that you choose. By continuing to use this Website you represent and warrant that:
11.5.1    all information you submit is accurate and truthful; and
11.5.2    you will keep this information accurate and up-to-date.
Your creation of an Account is further affirmation of your representation and warranty.
 
12.              Termination
12.1          Either KSOL or you may terminate your Account. If KSOL terminates your Account, you will be notified by email without explanation. Notwithstanding the foregoing, we reserve the right to terminate without giving reasons. All tests will be removed from the system after the termination comes into place.
12.2          If KSOL terminates your Account, any current or pending purchases on your Account will be cancelled and will not  be provided.
12.3          If KSOL terminates your account as a result of your breach of these Terms and Conditions you will not be entitled to any refund for subscriptions.
12.4      KSOL reserves the right to cancel purchases without stating reasons, for any reason prior to processing payment and dispatch.
12.5          If KSOL terminates your account or subscription for any other reason, you WILL NOT be refunded any remaining balance of your Subscription Fee. 
12.6          If purchases which are not electronic are cancelled for any reason prior to dispatch you will be refunded any monies paid in relation to those purchases. If any any material provided as part of KSOL’s service’s and products are cancelled for any reason prior to start of the course then your registration fee will not be refunded is one has been paid.
12.7          If you terminate your online Account any non-dispatched purchases will be cancelled and if you are in the first 7 days you will be refunded (with the exception of the registration fee if any is paid), any monies paid in relation to those purchases. No refunds are given after the first 7 days. Access to all online tests will be removed once cancellation has been made.
13.              Goods, Pricing and Availability
13.1          Whilst every effort has been made to ensure that all graphical representations and descriptions of Goods available from KSOL correspond to the actual Goods, KSOL is not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct Goods, not different Goods altogether. Please refer to Clause 15.1 for incorrect Goods.
13.2          Where appropriate, you may be required to select the required number or features of the Goods that you are purchasing.
13.3          KSOL does not represent or warrant that such Goods will be available. Stock indications ARE NOT provided on the Website..
13.4          All pricing information on the Website is correct at the time of going online. KSOL reserves the right to change prices and alter or remove any special offers from time to time and as necessary. 
13.5          In the event that prices are changed during the period between an order being placed for Goods and KSOL processing that order and taking payment, you will be contacted prior to your order being processed with details of the new price;
13.6          All prices on the Website do include VAT. KSOL’s VAT number is 884 1496 87.
14.              Delivery
14.1          KSOL may not always  notify you by way of email when your goods are to be dispatched to you. 
14.2          If KSOL receives no communication from you, within 7 days of delivery, regarding any problems with the Goods, you are deemed to have received the Goods in full working order and with no problems.
15.              Returns Policy
KSOL aims to always provide high quality Goods that are fault free and undamaged. On occasion however, goods may need to be returned. Returns are governed by these Terms and Conditions.
15.1          If you receive Goods (not online test or Mock exams) which do not match those that you ordered, unless accompanied by an explanatory note detailing the changes, stating reasons for the changes and setting out your options, you should contact us within 10 days to arrange its return. KSOL is not responsible for paying shipment costs. You will be given the option to have the Goods replaced with those ordered (if available) or to be refunded through the payment method used by you when purchasing the Goods. Refunds and replacements will be issued upon our receipt of the returned Goods.
15.2          If any Goods (not online test or Mock exams) you have purchased have faults when they are delivered to you, you should contact KSOL within 28 days to arrange collection and return. KSOL is not responsible for paying shipment costs. Goods must be returned in their original condition with all packaging and documentation. Upon receipt of the returned Goods, the price of the Goods, as paid by you, will be refunded to you through the payment method used by you when purchasing the Goods.
15.3          If any Goods develop faults within their warranty period, you are entitled to a repair or replacement under the terms of that warranty.
15.4          If Goods (not online tests or mock exams) are damaged in transit and the damage is apparent on delivery, you should sign the delivery note to the effect that the goods have been damaged. In any event, you should report such damage to KSOL within 10 days and arrange collection and return. KSOL is not responsible for paying shipment costs. Upon receipt of the returned Goods, the price of the Goods, as paid by you, will be refunded to you through the payment method used by you when purchasing the Goods.
15.5          You have a statutory right to a “cooling off” period. This period begins once your order is complete and ends 14 working days after the Goods have been delivered. If you change your mind about the goods within this period, please return them to KSOL within 14 working days of receipt. You are responsible for paying shipment costs if Goods are returned for this reason.
15.6          If you wish to return Goods to KSOL for any of the above reasons, please contact us using the details on the telephone provided on our main website to make the appropriate arrangements.
15.7          KSOL reserves the right to exercise discretion with respect to any returns under these Terms and Conditions. Factors which may be taken into account in the exercise of this discretion include, but are not limited to:
15.7.1    Any use or enjoyment that you may have already had out of the Goods;
15.7.2    Any characteristics of the Goods which may cause them to deteriorate or expire rapidly;
15.7.3    The fact that the Goods consist of audio or video recordings or computer software and that the packaging has been opened;
15.7.4    Any discounts that may have formed part of the purchase price of the Goods to reflect any lack of quality made known to the Customer at the time of purchase.
Such discretion to be exercised only within the confines of the law.

17.2          No part of this Website is intended to constitute advice and the Content of this Website should not be relied upon when making any decisions or taking any action of any kind.

17.4          Whilst KSOL uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, all Users are advised to take responsibility for their own security, that of their personal details and their computers.
17.5          Whilst every effort has been made to ensure that all descriptions of services available from KSOL correspond to the actual services available, KSOL is not responsible for any variations from these descriptions.
 
18.              Changes to the Service and these Terms and Conditions
KSOL reserves the right to change the Website, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the Website following the changes. If KSOL is required to make any changes to Terms and Conditions relating to sale of Goods by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future.

20.1          To the maximum extent permitted by law, KSOL accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. Users should be aware that they use the Website and its Content at their own risk.
20.2          Nothing in these Terms and Conditions excludes or restricts KSOL’s liability for death or personal injury resulting from any negligence or fraud on the part of KSOL.
20.3          Nothing in these Terms and Conditions excludes or restricts KSOL’s liability for any direct or indirect loss or damage arising out of the incorrect delivery of Goods or out of reliance on incorrect information included on the Website.
20.4          Whilst every effort has been made to ensure that these Terms and Conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions. This term shall apply only within jurisdictions where a particular term is illegal.

22.              No Waiver
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
23.              Previous Terms and Conditions
In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.
24.              Third Party Rights
Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and KSOL.
25.              Communications
25.1          All notices / communications shall be given to us either by post to our Premises (see address above) or by email to support@ksol.co.uk. Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.
25.2          KSOL may from time to time send you information about our products and/or services. If you do not wish to receive such information, please  or reply with the message unsubscribe.
26.              Law and Jurisdiction
These Terms and Conditions and the relationship between you and KSOL shall be governed by and construed in accordance with the Law of England and Wales and KSOL and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
27.              Subscriptions
27.1          Subscription charges commence on the date that you activate your subscription. Your credit / debit card / Bank Account will be automatically re-billed on activation and then either monthly, quarterly, half yearly or yearly thereafter. 
27.2          Your first payment will be at the price advertised on the Website or as advised by a KSOL. KSOL reserve the right to change Subscription Fees from time to time and any such changes may affect your subscription rate:
27.2.1    increases in price will be reflected in your subscription on the date of the immediately subsequent renewal; and
27.2.2    decreases in price will be reflected in your subscription on the date of the immediately subsequent renewal.
27.2.3   Depending on the course start and end date, the second and last month of the subscription may be a pro rata amount. All other payments are part of the subscription service and are taken on the set date of payment.

27.3          If you terminate your subscription or account you will continue to have access to the Paid Content for the remainder of the Subscription Period you are currently in up until the renewal date (or a mutually agreed end date)  whereupon access will cease unless you choose to pay the Subscription Fee and reactivate your subscription. When applicable, a final pro rata payment will be taken on the date the cancellation notice is given.
27.4          If you have subscribed in error you must inform KSOL within 24 hours of subscribing and must not use the Website or its Content during that time in order to receive a full refund. If any substantial use can be traced through your Account, KSOL reserves the right to exercise judgement and discretion and may refuse a refund. In such circumstances you will continue to have access to the Paid Content for the duration of your Subscription Period.
28.              Use of Free Content
You may only print Free Content from the Website for personal purposes only unless otherwise indicated on the Website or unless given express written permission to do so by KSOL. Specifically you agree that:
28.1          you will not use the Free Content of the Website for commercial purposes unless given express written permission to do so by a Director of KSOL;

29.1          Payment of a Subscription Fee grants you a licence to use the Paid Content on the Website associated with your subscription for the duration of your subscription. You may use such Content for personal purposes only.
29.2          Commercial use of Paid Content is not permitted under the terms of a normal subscription. Please contact KSOL with any enquiries regarding the commercial use of any Content from this Website.
29.3          Under such a licence, you agree that:
29.3.1    you will not use the Paid Content of the Website for commercial purposes unless given express written permission to do so by a Director of KSOL;

30.              Product and service Specific Terms and Conditions

30.1          Online tests
KSOL will at all times ensure that online tests are scheduled and available for use at all times, unless the online tests are being:
a)                 modified and the timetable of test are being rescheduled.
b)                 subject to a computer outage.
c)                 revised by KSOL
 
The contents of the online tests are verified by KSOL staff, however, occasionally errors in the question or the explanations can occur. You should notify KSOL of any errors spotted immediately, whereby the error can be corrected. No financial refund will be provided for any question that is incorrect.
Should an online test be not available, then it is your responsibility to inform KSOL of the missing test. KSOL will endeavour to provide the missing tests within 3 days.
The user agrees that the information made available in the online tests is provided to help students, however, no guarantees are made that a student using a KSOL online course will receive a successful outcome for any selection tests that a student may be undertaking.
The complexity level, duration and timing of any online test will be determined by KSOL and not by the user.
Any missing online test must be reported in 3 days of the test no being available.

30.2       Subscription & rebilling
Certain goods and services are subject to a subscription fee. By purchasing a subscription service you agree to pay according to the terms set.  Should payment be missed or not collected by KSOL then any outstanding payment will be collected when the error comes to light. Payment will be taken from the card originally supplied. In the event of the original card details no longer being valid, KSOL will contact the user to arrange alternative payment.  KSOL will not be responsible for any bank charges incurredby the user. Depending on the course start and end date, the second and last month of the subscription may be a pro rata amount. All other payments are part of the subscription service and are taken on the 1st of each month.
 
30.2.1    Cancellations & refunds
Each goods or service has a defined cancellation notice period. If one is not mentioned otherwise for the service, then the cancellation notice period is 1 calendar month.
Refund Policy: 
All cancellations and refund requests MUST be made in writing to: cs@ksol.co.uk
Said requests will only become valid once the customer receives a confirmation back from KSOL. If this is not confirmed within 3 working days, it is the responsibility of the customer to contact KSOL directly on 0121 733 6558 to ensure the request has been processed. KSOL will aim to issue refunds within 14 days of confirming the customer request. In addition to the refund policy mentioned in this document, KSOL will only refund in respect of the product for the amount paid or pro rata of the amount paid and will not be liable for any additional costs bourne by you in respects of the product or service received.


30.3       Services & Programmes
 
30.3.1     Mock Exams
You may purchase mock exams from KSOL. You understand that purchasing KSOL’s Mock Exams does not give the parent or guardian or “lawfully nominated representative” automatic right to view the exam paper.
If it is found that the child of the parent or guardian or “lawfully nominated representative” has a conflicting commercial interest then that child can be removed from the exam.
You accept that KSOL has the right to terminate your attendence to any exam and a refund of the outstanding amount provided. For example, if you purchase 4 exams and have attended 2 exams and  KSOL cancels your attendence to the remaining exams, KSOL will refund the pro-rated amount for 2 exams.
If you are unable to attend a booked exam, then notice must be given no later than 2 weeks prior to the start of the exam. No refund is given for cancellations that are made within 2 weeks prior to the start of the exam booked.
For cancellations made within the 2 week period in extenuating circumstances, KSOL may be able to offer a refund of up to 25% of the original booking price however this facility CANNOT be guaranteed and will be provided at the discretion of KSOL. Under circumstances where another mock exam event is available, KSOL may offer to transfer your child’s booking, subject to an administration fee of £20. Any alterations would make the booking non-transferable to any other product or course offered by KSOL and be subject to availability.
Please note that any special discounted rate on block mock exam bookings will no longer apply when 1 or more exams are cancelled within that booking. The rate per exam will return to the normal price (£65 for non-members and £60 for members) and the amount refunded will be the difference between the amount paid on the special offer and the total cost of the remaining exams (at normal price). Only cancellations made before 2 weeks of the exam date will be offered a refund. 

30.3.2        Masterclass Programme or any centre based activity/event
KSOL tuition centres run weekly all year round, throughout school holidays except for 1 week at Easter and 2 weeks at Christmas. The user will be notified of the dates in due course.

Your monthly payments will still remain the same on the Easter and Christmas holiday weeks, when KSOL centres are closed.

Whilst parents may wish to take holidays during the KSOL programme, we do not recommend extended holidays (i.e more than 2 week holidays). From past experience, we know that extended holidays can be very detrimental to children’s progress on the programme.
Parents are not permitted to use any recording devices or equipment at any of the centre sessions or parent consultations. Doing so is a breach of child protection, data protection and customer confidentiality and will be dealt with as a serious matter. 

If your child is unable to attend on their normal teaching session, you will not receive any refund for that session, as we have allocated that place to your child. We will, however, post out any homework/classwork from that session in due course.

If the user decides to transfer from one centre to another centre on a permanent basis, please note this will incur a £25 administration fee.

If the centre is closed due to adverse weather conditions or other situations that are beyond the control of KSOL, then alternative arrangements may be provided, but this is not guaranteed. No refund is provided in lieu. An online replacement will be provided that may be available that is of equal value.
 
 30.3.3         Early Starter Programme
Cancellation Notice Period: Within 14 days of registration

Refund Policy:
Full refund of course fee (NOT including registration fee) in first 14 days of service. 
All cancellations and refund requests MUST be made in writing to: cs@ksol.co.uk. Said requests will only become valid once the user receives a confirmation back from KSOL. 30.3.4          Online Intensive Programmes
Cancellation Notice Period: Within 14 days of registration

Refund Policy:
Full refund of course fee (NOT including registration fee) in first 14 days of service.

30.3.5          Revision Courses
Cancellation Notice: 1 calendar month before start date of assigned course.

Refund Policy:
Cancellations made prior to 1 calendar month before the assigned course start date will be issued a full refund; Cancellations made within 1 calendar month of the assigned course start date will NOT be issued a refund.
KSOL will aim to issue refunds within 14 days of confirming the user request.
 
30.3.6           One to One sessions
Cancellation Notice Period: 2 Weeks before the day of assigned One to One session.

Any changes to session times and dates MUST be requested prior to 2 weeks of the assigned One to One session.

Refund Policy:
Cancellations made prior to 2 weeks before the assigned one to one session start date will be issued a full refund; Cancellations made within 2 weeks of the assigned One to One session start date will NOT be issued a refund.
KSOL will aim to issue refunds within 14 days of confirming the user request.

Other Key Information:
Any changes to session topics MUST be requested 7 working days before the assigned One to One session.
 
30.3.7            Creative Writing
Cancellation Notice: 1 calendar month before start date of assigned course.

Refund Policy:
•    Cancellations made prior to 1 calendar month before the assigned course start date will be issued a full refund; Cancellations made within 1 calendar month of the assigned course start date will NOT be issued a refund.
•    KSOL will aim to issue refunds within 14 working days of confirming the user request.
 

30.3.8            Workshops

Cancellation Notice Period: 2 Weeks before the day of assigned workshop date.

Any changes to session times and dates MUST be requested prior to 2 weeks of the assigned workshop date.

Refund Policy: Cancellations made prior to 2 weeks before the assigned workshop start date will be issued a full refund; Cancellations made within 2 weeks of the assigned workshop start date will NOT be issued a refund.

KSOL will aim to issue refunds within 14 days of confirming the user request.

30.3.9             Booster Courses

Cancellation Notice: 1 calendar month before start date of assigned course.

Refund Policy: Cancellations made prior to 1 calendar month before the assigned course start date will be issued a full refund; Cancellations made within 1 calendar month of the assigned course start date will NOT be issued a refund.

KSOL will aim to issue refunds within 14 days of confirming the user request.

30.3.10            Graduate OR any other online subscription based service of KSOL

This product is a subscription based service.
Pay-as-you go – You don’t pay if you don’t require the use of KSOL (Subject to you giving one months notice).
Credit/Debit Card used to book the course will be automatically re-billed every 30 days. Depending upon the payment cycle individuals should allow up to 7 days after the renewal date for the card to be charged.

If a card payment is missed by KSOL, KSOL will automatically re-bill when the missed payment is discovered. If however, in the unlikely event that more than 2 months of payment have been missed by KSOL, then we will debit 2 months payment and contact the individual for any additional months. If contact is unsuccessful then we will automatically debit the card for the remaining months.

Tests will be delivered Mon-Fri.
KSOL has the right to cancel subscription at any point.
Refunds will only be accepted in the first 2 weeks of starting the course.
Registration fee is not refunded.

30.4        Charges for late pick-ups - Masterclass, 121 sessions, Workshops, Revision courses & Mock Exams

Any late pick ups interrupt staff time, so a charge of £10 will be applied to parents arriving more than 15 minutes after the session finish time. This fee of £10 will be charged for every 15 minutes (after first 15 mins)  that a child is under the care of KSOL staff over the agreed allocated time.

 
30.5        Points
Points are allocated to certain paid for products. However, points may need to be adjusted if it is found that there is an error in the allocated points. This will be done you will be informed of the reason if you request notification. All points must be claimed within 30 days of when the service is cancelled or terminated.

Each of the restrictions contained in this agreement is intended to be separate and severable.  In the event that any of the restrictions set out above shall be held to be void, then its/their deletion shall not affect the remainder of this Agreement, whose conditions shall continue to apply.

30.6        KSOL prize draw or competition

Publishing terms: 1. Our prize draws and competitions are organised by Key Stages Online Ltd, Skan House, 425 - 433 Stratford Road, Shirley, West Midlands, B90 4AE. (thereafter referred to as The Promoter in this document) How to enter:

 

2. Entries received after the stated closing date will not be accepted.

 

3. Closing dates and times should always be taken to reference UK Time zone.

 

4. Our prize draws and competitions are free to enter and no purchase is necessary

 

5. The Promoter will not accept responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

7. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.

 

Eligibility: 8. Unless otherwise stated, our prize draws and competitions are open to specific age groups as detailed in each competition unless it is stated that it is open to all.

 

9. Exceptions exist; entries from the following will be discarded: (a) Employees of The Promoter and their families. (b) Employees of any subsidiary company of The Promoter. (c) Agents or any third party directly associated with administration of the prize draw.

 

10. Entrants under 18 must get consent from their parent(s) or legal guardian(s) before entering. The parent(s) or legal guardian(s) of entrants under 18 agree to these Terms and Conditions on behalf of the entrant.

 

11. Only one entry per person is permitted.

 

12. In entering, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the prize draw or competition.

 

13. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw or competition.

 

The Draw: 14. Depending on the prize draw or competiton: a. A winner will be chosen by random draw performed by a process which is normally within 30 days of the prize draw or competition ending. or b. A winner will be chosen by a judge or panel of judges. Their decision will be final and no further correspondence can be entered. This will normally take place within 30 days of the competition ending.

 

15. The winner will be notified by email or telephone (using details provided at entry) within 7 days of being chosen and must provide a postal address to claim their prize. If a winner does not respond to The Promoter within 14 days of being notified, then the winner’s prize will be forfeited and The Promoter will be entitled to select another winner in accordance with the process described above.

 

16. The prize will be sent to the winners’ address as held by The Promoter. It is the entrants responsibility to ensure that the details sent are correct.

 

17. The prize is non-exchangeable, non-transferable and no cash alternative is offered. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond The Promoter's control makes it necessary to do so.

 

18. The decision of The Promoter regarding any aspect of the prize draw or competition is final and binding and no correspondence will be entered into about it.

Limitation of liability: 20. 24. Entrants hereby irrevocably submit to the exclusive jurisdiction of the courts of England to settle any such dispute or issue.

 

25. The Promoter reserves the right to update these Terms and Conditions from time to time and any updated version will be effective as soon as it is published on the website.

 

Ownership: 26. The promoter will not accept entries that are illegal in anyway.

 

27. All entries become the property of The Promoter. The entrant irrevocably transfers all rights and ownership and future rights and ownership to The Promoter.

 

28. The person or persons or team entering the competition agrees that the work or item submitted for the competition is original and has not been copied or in parts been plagiarised from other material.

 

29. By submitting your entry to the promoters’ prize draw or competition, you confirm that: a. the competition entry is your own work and you have not purchased or used someone else’s material for the entry b. the competition entry has not been used anywhere else;
